1. Definitions and Interpretation

• 1.1. Program: Refers to the PayMyTravel Loyalty Membership Program operated by PayU Travel Pvt. Ltd. ("Company").
• 1.2. Member or You: Refers to any individual who has successfully enrolled in the Program.
• 1.3. PayMyMiles: Refers to the loyalty reward currency earned under this Program. These are distinct from any other currency and hold no cash value until redeemed.
• 1.4. EMI/BNPL Partner: Refers to third-party financial institutions, NBFCs, or banks providing credit facilities integrated into the Program.
• 1.5. Force Majeure Event: Refers to any event beyond the reasonable control of the Company, including acts of God, war, strikes, pandemics, government restrictions, technical failures, or banking system outages.

2. Membership Eligibility and Enrollment

2.1. Enrollment Criteria: Membership is open to individuals who are 18 years of age or older and residents of India. Enrollment is subject to the acceptance of these Terms.

3. Earning and Redemption of PayMyMiles

• 3.1. No Cash Value: PayMyMiles are promotional units and have no monetary or cash value. They cannot be exchanged for cash, cheque, or bank transfer.
• 3.2. Earning Protocol: PayMyMiles are earned on the Net Transaction Value (excluding taxes, convenience fees, and insurance) unless otherwise specified.
• Points are credited only after successful completion of the travel or service (i.e., after check-out or flight landing).
• In the event of cancellation or refund, any PayMyMiles earned on that transaction will be reversed. If already utilized, the equivalent value will be deducted from the refund amount.
• 3.3. Redemption Restrictions: PayMyMiles can only be redeemed for services listed on the PayMyTravel platform.
• The Company reserves the right to impose blackout dates during which redemption may be restricted or unavailable.
• Redemption caps may apply and are subject to change without prior notice.
• 3.4. Expiry: PayMyMiles are valid for 12 months from the date of earning. Expired points cannot be reinstated.
• 3.5. Dynamic Valuation: The Company reserves the right to adjust the redemption value of PayMyMiles at any time without prior notice.

4. EMI and BNPL Benefits Disclaimer

• 4.1. Third-Party Liability: EMI, BNPL, and credit facilities are provided by third-party lenders. PayMyTravel is only a facilitator and not a lender.
• 4.2. No Guarantee of Approval: Faster approvals and pre-approved limits are subject to lender discretion and Member creditworthiness.
• 4.3. Dispute Resolution: EMI disputes, repayment schedules, or interest charges must be resolved directly with the lending partner.
• 4.4. EMI Holiday: EMI Holiday benefits are subject to lender policy and clean repayment records.

5. Limitation of Liability and Indemnification

• 5.1. General Limitation: PayMyTravel shall not be liable for direct, indirect, incidental, special, consequential, or punitive damages arising from the use of the Program.
• This includes inaccuracies in point balances, unauthorized data access, service failures, and partner delays.
• 5.2. Cap on Liability: Total liability shall not exceed the value of the PayMyMiles held or INR 1,000, whichever is lower.
• 5.3. Third-Party Services: PayMyTravel is not responsible for services provided by airlines, hotels, or insurers.
• 5.4. Indemnification: Members agree to indemnify and hold harmless PayMyTravel against all claims, liabilities, and legal expenses.

6. Modification and Termination of Program

• 6.1. Right to Modify: The Company reserves the right to modify, suspend, or terminate the Program at any time.
• Earn rates, redemption values, tier criteria, and benefits may change without notice.
• 6.2. Effect of Termination: Members will receive a 30-day notice period to redeem accumulated PayMyMiles.
• After the notice period, all unredeemed PayMyMiles will be forfeited without compensation.
• 6.3. Termination for Cause: Fraud, abuse, EMI defaults, law violations, or harassment may result in immediate account termination.

7. Governing Law and Dispute Resolution

• 7.1. Governing Law: These Terms are governed in accordance with the laws of India.
• 7.2. Jurisdiction: Courts located in Gurugram, Haryana, India shall have exclusive jurisdiction.
• 7.3. Arbitration: Disputes may be referred to arbitration under the Arbitration and Conciliation Act, 1996.

8. Privacy and Data Usage

• 8.1. Consent: Members consent to the collection, usage, and sharing of personal and financial data for Program administration.
• 8.2. Data Sharing: Data may be shared with credit bureaus and lending partners for pre-approved offers and EMI benefits.
• 8.3. Marketing: Members agree to receive promotional communications via email, SMS, push notifications, or WhatsApp.
